Visa Information for International Students

Optional Practical Training (OPT) Pertinent to students on F1 Visa Eligibility: Those students who had an F1 status for nine consecutive months, you get 12 months of work permit (Optional Practical Training: OPT) during or after studies. The work must be related to your field of studies and you must maintain legal status throughout. These twelve months of OPT quota is fixed even if you chyange your status from undergrad to graduate/master (or if you change universities) unless you go out of the country for a period greater than five months and then come back for another degree. It is advised to apply 120 days in advance of your graduation date since it currently takes up to three months to get an work permit (EAD). You don't need to have a job offer before you apply for this permit. You can not leave the country while the OPT application is pending. Note: For many countries, obtaining a new visa while on OPT is difficult. OPT starts within three months of graduation date. Misc notes: During OPT, you can travel, provided F1 visa remains valid. Curricular Practical Training This is a very limited option applicable to people who need work training as a part of degree requirements. Needful Things: 2 letters of recommendation (one from employer, one from adviser). The letter from employer should state the duties you'll be carrying out, while the letter from adviser should state that the internship is an integral part of the degree. This time spent will not count as part of work performed under OPT (see above). Pertinent to students on J1 Visa J1 visa is usually valid for 36 months following which you can get 18 months of OPT. Beware of the two year home rule. One can apply for waivers to the two year home rule. After Graduation Postdoctoral positions Start with an OPT and then switch to J1. If you need, apply for waiver of the two year home rule. Working under an H1 visa H1 visa is an work visa valid for six years. Start with an OPT and ask your employer to apply for an H1 by Oct 1st because allocation is on federal fiscal year which starts on Oct 1st. This will ensure that you are at the top of the que for the next year's quota. One can switch employers under this visa status, but the six year time frame is fixed.
