To apply for an H-1B visa, you must first speak with an OISS staff member to determine whether the candidate meets the eligibility and Yale sponsorship requirements for H-1B status. If you are applying for H-1B status for a person who is already at Yale, the individual must speak with an OISS advisor before initiating the process. Please call OISS at 432-2305 to schedule an appointment.

All H-1B applications must include:
All employers, including institutions of higher education, are required to pay a $500 anti-fraud (“fraud protection and detection”) fee. This applies to new or initial petitions and not to extensions for those who already hold the H-1B status for Yale employment. This fee may not be paid by the scholar. Checks should be payable to “The Dept. of Homeland Security.”
The base petition fee, for the filing of the H-1B petition, is $320. This fee may be paid by the international scholar IF the payment of this fee does not effectively reduce the amount of the prevailing wage or actual wage indicated in the paperwork prepared. EG. Postdocs who will be paid at the minimum level dictated by University policy, or $37,000, may not pay the petition fee, as it “effectively drops the alien’s salary” below that minimum level. In this case, the department would be responsible for both the anti-fraud and the petition fees. Checks for the petition fees should also be payable to “The Dept. of Homeland Security," and may not be combined in one check.
